Furthermore, the law requires that a person take all reasonable steps to ensure their partner&#8217;s consent<\/span>.<\/p><p><b><span style=\"text-decoration: underline;\">Consent is not valid if<\/span>:<\/b><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It is expressed by a person other than the victim;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The victim is incapable of consenting to the activity;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The perpetrator abuses the victim&#8217;s trust and uses his position of authority and power to obtain what he desires;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The victim expresses refusal, through words, gestures, behaviour, or any other means.<br \/><br \/><\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-59d3f13 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"59d3f13\" data-element_type=\"section\" data-e-type=\"section\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;}\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-0eb4109\" data-id=\"0eb4109\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-1725a9b elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"1725a9b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400; color: #ffffff;\">Furthermore, a person who has consented to engage in sexual activity may at any time express refusal to continue, through words, gestures, behaviour, or any other means.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-e7d812c elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"e7d812c\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-ea12c55\" data-id=\"ea12c55\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-814bb4f elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"814bb4f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h2><strong><b>Age of Consent<\/b><\/strong><\/h2><p><span style=\"font-weight: 400;\">The age of consent in Canada is 16 years, which means that a person aged 16 and under cannot give consent to sexual intercourse. However, there are certain exceptions where the law does not consider it criminal:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A person aged 14 or 15 who consents to have sexual intercourse with another person less than five years older;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A person aged 12 or 13 who consents to have sexual intercourse with another person less than two years older.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">These exceptions are only valid if the older person is not in a position of authority or trust and it is not a case of exploitation.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-d71c097 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"d71c097\" data-element_type=\"section\" data-e-type=\"section\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;}\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-b8e588f\" data-id=\"b8e588f\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-ab85c24 elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"ab85c24\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #ffffff;\"><strong>The law also stipulates that a person under 12 years of age cannot under any circumstances consent to a relationship of a sexual nature<\/strong><\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-1a99f31 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"1a99f31\" data-element_type=\"section\" data-e-type=\"section\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;}\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-315f798\" data-id=\"315f798\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-ae31d35 elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"ae31d35\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h2><b>For consent to be considered valid, it must:<\/b><\/h2><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Be given by oneself (parents or romantic and sexual partners cannot give it on our behalf);<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Be given when the person is in a state to do so. If one is not capable of consenting to sexual activity (if one has consumed alcohol or drugs, if one is unconscious or asleep, etc.), the consent will not be considered valid;<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">It is possible to withdraw one&#8217;s consent at any time.
